Terms of Service

1. Acceptance of Terms

By accessing or using RealStage ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

RealStage is a SaaS platform that provides AI-powered virtual staging services for real estate professionals. Users can upload photos of empty rooms and receive professionally staged images generated using artificial intelligence.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Verifying your email address before using credit-based features
• Notifying us immediately of any unauthorized use of your account

4. Credit System and Billing

4.1 Credits

The Service operates on a credit-based system where 1 credit equals 1 image generation. New users receive 3 free credits upon email verification. Credits can be purchased through our platform via Stripe.

4.2 Purchases

All credit purchases are final and non-refundable except as required by law. Credits do not expire but may be subject to account termination policies.

4.3 Payment Processing

Payments are processed securely through Stripe. We do not store your payment card information on our servers.

5. Image Generation and Ownership

5.1 Uploaded Images

You retain all rights to images you upload to the Service. By uploading images, you grant us a license to process, store, and use them solely for the purpose of providing the Service.

5.2 Generated Images

You own the AI-generated staged images created through the Service and may use them for commercial purposes. Generated images are automatically deleted 30 days after creation. Original uploaded images are retained unless you delete the project.

5.3 AI Content Disclaimer

Images are generated using third-party AI services (Nano Banana). While we strive for quality, we do not guarantee the accuracy, quality, or suitability of generated images for any particular purpose. You are responsible for reviewing all generated content before use.

6. User Responsibilities

You agree not to:

• Upload images containing illegal, offensive, or copyrighted content
• Abuse the free trial system by creating multiple accounts
• Attempt to reverse engineer or compromise the Service
• Use the Service for any unlawful purpose
• Share your account credentials with others
• Exceed reasonable usage limits or engage in activities that harm the Service

7. Service Limitations

We reserve the right to:

• Limit the number of images per project (currently 15 images)
• Set file size limits for uploaded images
• Implement rate limiting to prevent abuse
• Modify, suspend, or discontinue any aspect of the Service
• Refuse service to anyone for any reason

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.

9. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by RealStage and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Account Termination

10.1 By You

You may delete your account at any time through your account settings. Upon deletion, all your data, images, and unused credits will be permanently removed.

10.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. No refunds will be provided for terminated accounts.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALSTAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or malicious code transmitted through the Service
• The quality or suitability of AI-generated content
• Any errors or omissions in any content

12. Indemnification

You agree to indemnify and hold harmless RealStage and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RealStage operates, without regard to its conflict of law provisions.
